By accessing and using WayaSend's platform, mobile application, and related services (collectively, the "Services"), you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using WayaSend's Services, you shall be subject to any posted guidelines or rules applicable to such services. If you do not agree to abide by these terms, please do not use our Services. We reserve the right to modify these terms at any time, and your continued use of the Services constitutes acceptance of any modifications.

To use our Services, you must create an account. When creating an account, you agree to: • Provide accurate, current, and complete information • Maintain and promptly update your account information • Keep your password secure and confidential • Accept responsibility for all activities that occur under your account • Notify us immediately of any unauthorized use of your account • Be at least 18 years of age and have the legal capacity to enter into binding contracts We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our sole discretion.

WayaSend operates as a marketplace connecting users with independent couriers. Here's what you need to know: • Pricing: Delivery fees are determined through a competitive bidding system where couriers offer their services • Payment: Payments are processed securely through our platform. All fees are final unless disputed • Service Fees: We may charge additional service fees for platform usage, which will be clearly disclosed • Cancellations: Cancellation policies apply based on delivery status. Refunds are processed at our discretion • Promotions: Any promotional offers or discounts are subject to specific terms and conditions Couriers are independent contractors and not employees of WayaSend.

When using our Services, you agree NOT to: • Violate any laws, regulations, or third-party rights • Post or transmit harmful, threatening, abusive, or discriminatory content • Impersonate any person or entity • Engage in fraudulent or deceptive practices • Interfere with or disrupt the operation of our Services • Attempt to gain unauthorized access to our systems • Harass, threaten, or intimidate couriers or other users • Use the Services for any illegal or unauthorized purpose • Attempt to circumvent our security measures or pricing algorithms Violations may result in account termination and potential legal action.

The following items are prohibited from being shipped through our platform: • Illegal substances, drugs, or narcotics • Weapons, firearms, ammunition, or explosive materials • Hazardous materials, chemicals, or toxic substances • Counterfeit or pirated goods • Stolen property • Items that violate copyright or trademark rights • Live animals or wildlife products • Perishable food items requiring special handling • Medical waste or biohazardous materials • Currency, securities, or valuable documents We reserve the right to refuse, hold, or inspect any package suspected of violating these terms.

WayaSend provides the Services "as is" and "as available" without warranties of any kind. We do not guarantee that: • The Services will be uninterrupted, secure, or error-free • The Services will meet your specific requirements • The information or content on our platform is accurate or reliable To the maximum extent permitted by law, WayaSend shall not be liable for: • Indirect, incidental, special, or consequential damages • Loss of profits, data, or business opportunities • Damages resulting from delays or delivery failures • Actions or conduct of third-party couriers • Any matters beyond our reasonable control Our total liability shall not exceed the amount paid by you for the specific delivery in question.

All content, features, and functionality of our Services are owned by WayaSend and are protected by copyright, trademark, and other intellectual property laws. This includes: • The WayaSend name, logo, and branding • Software, code, and technology • User interfaces and design elements • Documentation and content You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent. Unauthorized use may result in legal action.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including: • Breach of these Terms and Conditions • Violation of any applicable laws or regulations • Fraudulent or illegal activity • Non-payment of fees or charges • Failure to maintain accurate account information • Behavior that harms other users or our business Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall remain in effect.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising from these terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Zimbabwe. Before initiating any legal action, you agree to attempt to resolve disputes through good-faith negotiation. If resolution cannot be reached, disputes may be submitted to binding arbitration in accordance with the Arbitration Act of Zimbabwe. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
